Advance Care Planning: The Little-Known Tool for Maintaining Control Over Your Assets

In light of an aging population and the rise in situations of dependency, the advance care directive has emerged as a key tool for estate planning. Although underutilized, this legal mechanism helps prevent decisions that are imposed on individuals—and are often contentious—when a person loses capacity.
 

In France, more than one million people are currently under guardianship or conservatorship because they were unable to make advance arrangements for the management of their affairs. This number is expected to rise as life expectancy increases and neurodegenerative diseases become more prevalent. In this context, the advance care directive emerges as a discreet yet strategic legal tool, allowing everyone to plan for their own protection before it is too late.
 

Plan ahead rather than be forced to accept a measure imposed on you
Designed to address life’s unforeseen events (old age, stroke, disability, cognitive impairment), the advance care directive allows any adult to designate in advance a trusted representative who will act in accordance with their wishes when they are no longer able to manage their own affairs.
 

“It’s essentially a preventive agreement that allows you to remain in control of your future, even when you are no longer able to express your wishes,” notes Pascale Gloser, president of CNCEF PATRIMOINE.
 

Unlike guardianship or conservatorship—which are ordered by a judge once a loss of autonomy has been established—a power of attorney is based on a personal choice: the choice of the attorney-in-fact, the scope of their powers, and the priorities to be followed.
 

Personal Life, Assets, and Business: A Broad Scope
The power of attorney can cover very practical aspects of daily life. It may authorize the agent to manage bank accounts, pay routine expenses, make financial decisions, or manage real estate. It may also provide a framework for sensitive decisions, particularly medical ones, such as choosing a course of treatment, selecting a care facility, or refusing medically futile treatment.
 

Beyond personal circumstances, this tool is also used to protect a child with a disability by ensuring the continuity of the management of his or her assistive devices and assets, or to safeguard a business by designating who will make strategic decisions if the CEO becomes temporarily or permanently incapacitated.
 

A flexible arrangement, but one that requires rigor
The power of attorney may be drawn up as a private document, based on an official template, or as a notarized deed. This second option, which offers greater protection, allows, in particular, for the creation of a detailed inventory of assets and the appointment of a monitor responsible for overseeing the agent’s actions, thereby limiting the risk of abuse or family disputes.
 

One point to keep in mind: there is no central registry for advance care directives. It is therefore essential that the person’s loved ones be informed of its existence so that it can be activated when the time comes.
The power of attorney takes effect only upon a medical determination of diminished mental capacity, formalized by a certificate filed with the court clerk’s office. As long as it has not been activated, the grantor may freely amend or revoke it. Once it has taken effect, it can be terminated or amended only through the intervention of the guardianship judge.
 

In a society where dependency is becoming a financial risk in its own right, the advance care planning directive has emerged as an essential tool for planning ahead—one that is still underutilized. It is an instrument that is at once legal, financial, and deeply human, enabling individuals to avoid having decisions imposed on them—decisions that are often painful—at a time when vulnerability makes it impossible to respond.
